SECTION 00 11 13 – ANNOUNCEMENT FOR CONSTRUCTION TENDERS OWNER: Cass Rural Water District (CRWD) ADDRESS: 131 Maple Street, Kindred, ND 58051 Separate Sealed Tenders for Construction of CRWD – NDSP Pipeline Improvements; will be received at the Office of Advanced Engineering and Environmental Services (AE2S), 4170 28th Ave S, Fargo, ND, 58104, until 2:00 p.m. local time September 29, 2022 where and at what time shortly thereafter they will be opened publicly and read aloud. Tenders may be mailed to: AE2S Attn: Chase Julson, PE 4170 28th Ave S Fargo, ND 58104 The work comprises one (1) contract: Contract No. 1 – Pipeline Construction. The works are generally described as follows: Contract No. 1: Construction of pipes: Construction of rural water supply and return pipes comprising the supply and installation of the following approximate quantities: 126,000 feet of pipe in 8-inch DR 11 IPS polyethylene, 148,000 feet of 12-inch pipe – DR 11 IPS polyethylene pipeline, 8,000 feet of 8-inch DR 11 IPS polydirectional boreholes, 9,000 feet of 12-inch DR 11 IPS polydirectional boreholes, six (6) steel railroad boreholes with poly carrier tube; six (6) poly bores with poly carrier pipe, sixty (60) fused poly elbows/fittings, twelve (12) 8 inch gate valves, fifteen (15) 12 inch gate valves, four (4) 1 inch air valves dump valves (ARV), one (1) hydrant assembly and all associated fittings and accessories, restoration, flushing and testing, signaling, seeding and gravelling . All bids must be contained in a sealed envelope clearly marked that this envelope contains a bid for the project. Also refer to section 00 21 13 for preparation of submission information. All bids must be prepared in accordance with the instructions to bidders contained in the project manual. Each bid must be accompanied by a separate envelope containing bid security in the form of a bidder’s bond signed by the bidder as principal and a surety company licensed to do business in the State of Dakota du Nord, payable to the Cass Rural Water District, in an amount equal to five percent (5%) of the total amount of the Offer. The surety must be listed as a certified surety in U.S. Treasury Department Circular 570A. A certified check instead of a surety company in the amount of 5% of the total cost of the project will not be accepted. This is to serve as a guarantee that the successful bidder will enter into a contract within ten (10) days of notice of award, in accordance with the terms of the principal’s offer and the contractor’s bond, as required by law. and Cass Rural Water District regulations and rulings for the performance of such work. Only offers accompanied by such a guarantee will be taken into consideration. All work shall be performed in accordance with the tender documents filed in the Cass Rural Water District Office, Kindred, ND, where they may be viewed and examined. Bidders must be licensed for the full amount of the bid as required by North Dakota Century Code 43-07-05. Each bid must contain a copy of the contractor’s license or renewal certificate issued by the Secretary of State. All tenders must be submitted on the tender form provided by the engineer. No tender will be read or considered unless it fully complies with the above and other provisions contained in the tender documents, and any defective tender submitted will be returned to the tenderer unopened. Each bidder must possess a valid North Dakota contractor’s license for the full amount of their bid, as required by NDCC § 43-07-07. Each bid must be accompanied by a copy of the bidder’s contractor’s license or certificate of renewal, issued by the North Dakota Secretary of State, and each license must be valid and dated at least 10 days prior to the date set for the opening of tenders, as required. under NDCC § 43-07-12. The District will not read or consider any offer that does not include the bidder’s bond and contractor’s license or renewal, as described above, and that does not fully comply with the requirements of NDCC § 48-01.2 -05. Bidders for this work will be required to comply with Presidential Executive Order No. 11246, as amended. Requirements for bidders and contractors under this order include EQUAL EMPLOYMENT AND AFFIRMATIVE ACTION REQUIREMENTS, DAVIS-BACON WAGE RATE REQUIREMENTS, AND U.S. IRON AND STEEL REQUIREMENTS, as explained in the specs. Bidders for this work will be required to comply with Title 40 CFR Part 33 – Participate by Disadvantaged Business Enterprises in the United States Environmental Protection Agency Programs. The requirements for bidders and contractors under this regulation relate to the use of Minority Business Enterprises (MBE), Women’s Business Enterprises (WBE) and Small Business Enterprises (SBE) and are explained in the Specifications. The target for MBE is 2% of the total dollar value of the project. The target for WBE is 3% of the total dollar value of the project. Bidders must demonstrate a good faith effort to solicit MBE and WBE sub-contractors. The completed MBE/WBE Bid Information Sheet must be provided in the outer envelope of the Bid Security. If this information is not provided, the offer will not be opened. Bidders for this work will be required to comply with the US iron and steel requirements of the Consolidated Appropriations Act, 2014. The requirements for bidders and contractors under this regulation are explained in the specifications. Contracts will be awarded on the basis of the lowest bid submitted by a responsible and responsive bidder deemed most favorable to the Owner’s interests. All bids must be contained in a sealed envelope clearly marked that this envelope contains a bid for the project. In addition, the tenderer must write the following information on the outside of this envelope: 1. Name of the project and work covered by the tenderer (general). 2. The Bidder’s name. 3. Separate envelope containing bid bond, non-collusion affidavit, copy of contractor license or certificate of renewal, MBE/WBE solicitation information, SRF certification regarding exclusion, suspension and other responsible matters. 4. The work for Contract No. 1 must be completed no later than the following: 1. Substantial Completion – June 1, 2024 2. Final Completion – July 1, 2024 All bids will be made on a cash payment basis for these works. After the opening of the bids, the Owner will return the bid security of all but the three lowest responsible bidders. When the contract is awarded, the remaining bonds of the unsuccessful bidder will be returned. The Owner reserves the right to reject any or all Bids, and further reserves the right to award the Contract in the best interests of the Owner.
