Pottawattamie County Supervisors Oppose Eminent Domain

Pottawattamie County is the latest to take a stand against eminent domain. The County Board of Supervisors recently passed a resolution stating its opposition to eminent domain for the construction of carbon capture pipelines. More than 20 other counties have done the same. Supervisors say they want companies like Summit Carbon Solutions to work with landowners on each individual property. if they want to move on. But in the end, the matter is not in the hands of the supervisor. The State’s Utility Board will have the final say. If licensed landowners were forced to sell their land for “fair market value” to the pipeline company, Summit said they were successful without using eminent domain.

Supervisors say they want companies like Summit Carbon Solutions to work with landowners on each individual property if they are to move forward. But in the end, the matter is not in the hands of the supervisor.

The State Utilities Board will have the final say. Whether licensed landowners would be required to sell their land at “fair market value” to the pipeline company.

Summit said they are finding success without using eminent domain.
